GDPR information clause for clients and contractors
Pursuant to Art. 13 section 1 and section 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation ), hereinafter referred to as: GDPR, we inform you that:
1. The administrator of your data is CHEMLEX Sp. z o. o. with headquarters at ul. Skowronków 7/107; 33-100 Tarnów. The company is entered in the register of entrepreneurs of the National Court Register no. 0000781749 by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register, NIP: 8733271041, REGON: 383120428., e-mail biuro@chemlex.com.pl, hereinafter referred to as CHEMLEX.
2. Your personal data will be protected and processed for the following purposes:
1. performance of contracts (pursuant to Article 6(1)(b) of the GDPR),
2. marketing of the company’s own products or services (Article 6(1)(f) of the GDPR – our legitimate interest is to provide information about our commercial offer,
3. guaranteeing the security of the online sales services provided by registering the IP addresses of the Website users (pursuant to Article 6(1)(f) of the GDPR, our legitimate interest is to ensure the security of services provided electronically),
4. implementation of our legitimate interest consisting in the possible determination or pursuit of claims or defense against claims (the legal basis for processing is Article 6(1)(f) of the GDPR).
3. Your personal data will be stored for the period necessary to achieve the purpose to which you consented, with systematic monitoring of their usefulness, no longer than every 3 years from the date of their introduction. In particular, they will be processed for the duration of the offer or the duration of the contract, but no longer than for the duration of the contract, and in the case of consent – until the consent is withdrawn. To the extent that the data is processed for the purpose of sending marketing content to you, it will be processed until you withdraw your consent or object to such processing. The period of personal data processing may be extended each time by the limitation period for claims, if the processing of personal data is necessary to pursue possible claims or defend against such claims by the ADO. After this period, the data will be processed only to the extent and for the time required by law, including tax and accounting law.
4. Your data will not be transferred to other entities except: a carrier or an intermediary carrying out postal shipments on behalf of the company, entities providing the company with services necessary to perform the contract concluded with you, including legal services, postal operators and couriers, banks in processing of payments, to certain persons practicing regulated professions, such as lawyers.
5. You have the right to: access the content of your personal data, including requesting a copy thereof and requesting its rectification, deleting personal data (the right to be forgotten), limiting the processing of personal data, the right to transfer personal data to another administrator, the right object to the processing of personal data, including profiling, and for direct marketing purposes, to withdraw consent in the event that the company will process your personal data based on consent, at any time and in any way, without affecting the lawfulness of processing which was made on the basis of consent before its withdrawal. You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of personal data violates the provisions of the GDPR.
6. You have the right to object to the processing of your personal data for the purpose of directing marketing content to you. In addition, you have the right to object to the processing of personal data for purposes arising from the legally justified interests of the company for reasons related to your particular situation.
7. Providing your personal data is voluntary, but necessary in order to answer the inquiry submitted via the contact form. Your personal data will not be subject to profiling.
